Welcome to MyBarber, a grooming and barber service platform operated by GROOMZY TECHNOLOGIES ("Groomzy Technologies", "we", "us", or "our"). By creating an account, booking a service, accessing our website or mobile application, or otherwise using the MyBarber platform (collectively, the "Service"), you agree to these Terms & Conditions ("Terms").

1. About MyBarber

MyBarber is a technology platform that connects customers with independent barbers, salons, stylists, and other grooming service providers ("Service Providers"). MyBarber provides the technology and booking platform that allows users to discover grooming services, view available appointments, make bookings, and communicate with Service Providers.

Service Providers listed on MyBarber may operate independently from Groomzy Technologies. The actual grooming services are provided by the respective Service Provider you select and book through the platform.

2. User Eligibility

You must be at least 18 years old to create an account and use MyBarber. By using the Service, you confirm that you are legally capable of entering into these Terms.

3. User Account and Responsibilities

• Accurate Information: You agree to provide accurate, current, and complete information when creating your account or making a booking.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account.
• Lawful Use: You must use MyBarber only for lawful purposes and must not use the platform for fraudulent, abusive, misleading, or unlawful activities.
• User Conduct: You must not harass, threaten, abuse, or otherwise engage in inappropriate behaviour towards barbers, stylists, Service Providers, MyBarber employees, or other users.
• Content: Any reviews, comments, photographs, or other content submitted by you must not be defamatory, obscene, hateful, fraudulent, or unlawful.

4. Grooming Services and Service Providers

MyBarber is a technology and booking platform. Grooming services, including haircuts, hairstyling, beard grooming, shaving, hair treatments, and other services listed on the platform, are provided by the respective Service Provider.

Service Providers are responsible for the services they provide, including their pricing, availability, service quality, hygiene practices, professional conduct, and compliance with applicable laws and regulations.

While Groomzy Technologies may take reasonable steps to maintain the quality and integrity of the MyBarber platform, we do not guarantee that every Service Provider or service will meet your individual expectations.

5. Bookings and Appointments

• Booking: You may book available grooming services through the MyBarber platform.
• Booking Confirmation: A booking is considered confirmed when confirmation is displayed through the Service or communicated to you through an authorised communication channel.
• Availability: Appointment availability is provided by the relevant Service Provider and may change from time to time.
• Changes: A Service Provider may, in exceptional circumstances, need to modify or cancel an appointment due to operational or other legitimate reasons.

6. Payments

Payments made through MyBarber may be processed using third-party payment service providers, including Razorpay or other payment providers made available through the platform.

Groomzy Technologies does not intentionally store sensitive card information such as complete card numbers or CVV details when such information is processed directly by the applicable payment provider.

You agree to provide accurate payment information and authorise the applicable payment provider to process payments associated with your bookings.

7. Cancellation, Rescheduling and No-Shows

Cancellation and rescheduling of appointments may be subject to the applicable Service Provider's cancellation policy.

• You may cancel or reschedule a booking through MyBarber where the relevant functionality is available.
• A Service Provider may apply a cancellation or no-show fee where such a fee was disclosed to you before or at the time of booking.
• The amount and conditions of any cancellation fee may vary depending on the Service Provider and the booking.
• Repeated cancellations, fraudulent bookings, or deliberate misuse of the booking system may result in restrictions on your account.

8. Refunds

Refund eligibility may depend on the circumstances of the booking, the applicable cancellation policy, and the payment method used.

Where a refund is approved, Groomzy Technologies may facilitate the refund through the applicable payment provider. Processing times may vary depending on the payment provider and the user's bank or financial institution.

9. Reviews and User-Generated Content

MyBarber may allow users to submit reviews, ratings, photographs, comments, or other content relating to their experience with a Service Provider.

You remain responsible for the content you submit. By submitting content to MyBarber, you grant Groomzy Technologies a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and distribute that content in connection with operating, promoting, and improving the MyBarber Service.

We reserve the right to remove or restrict content that we reasonably believe violates these Terms, applicable law, or the rights of another person.

10. Prohibited Activities

You must not:

• Use MyBarber for fraudulent or unlawful purposes.
• Create false or misleading accounts or bookings.
• Impersonate another person or Service Provider.
• Attempt to gain unauthorised access to another user's account.
• Interfere with the operation or security of the MyBarber platform.
• Upload malicious software, viruses, or harmful code.
• Submit fake, defamatory, abusive, or misleading reviews.
• Use automated systems to scrape or collect data from MyBarber without permission.
• Use the platform in a manner that could harm MyBarber, its users, or Service Providers.

11. Intellectual Property

All intellectual property associated with MyBarber, including the MyBarber name, logo, software, website, application, interface, graphics, text, design, and other platform materials, is owned by or licensed to GROOMZY TECHNOLOGIES, unless otherwise stated.

You may use the Service only for its intended personal and lawful purpose. You may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit any part of the MyBarber platform without our prior written permission, except where such restriction is not permitted by applicable law.

Your use of MyBarber is also subject to our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information.

13. Platform Availability

We aim to keep MyBarber available and functioning properly, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

The Service may occasionally be unavailable because of maintenance, technical issues, updates, network failures, or circumstances beyond our reasonable control.

MyBarber acts primarily as a technology and booking platform connecting users with independent grooming Service Providers. Groomzy Technologies does not directly provide every grooming service listed on the platform.

Information relating to a Service Provider, including service descriptions, prices, availability, photographs, and reviews, may be provided by the Service Provider or users and may change over time.

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited under applicable law.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Groomzy Technologies shall not be responsible for indirect, incidental, special, or consequential losses arising from your use of the Service.

Nothing in these Terms is intended to exclude or limit liability for matters that cannot legally be excluded or limited under applicable law, including applicable consumer protection rights.

16. Suspension and Termination

We may suspend or terminate your access to MyBarber if you violate these Terms, engage in fraudulent or abusive behaviour, misuse the platform, or where suspension or termination is reasonably necessary to protect MyBarber, its users, Service Providers, or comply with applicable law.

You may stop using MyBarber and request deletion of your account in accordance with our Privacy Policy and applicable law.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, business practices, or applicable legal requirements. Updated Terms will be published on the MyBarber website or application.

Your continued use of MyBarber after updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.

These Terms shall be governed by and interpreted in accordance with the applicable laws of India.

Subject to any mandatory rights or remedies available to consumers under applicable law, disputes arising in connection with these Terms or the MyBarber Service shall be subject to the jurisdiction of the competent courts in Karnataka, India.
